These Terms of Service (“Terms”) govern access to ClearFeedback operated by clearfeedback.io (“ClearFeedback,” “we,” “us”). By creating an account, using the dashboard, embedding the widget, or otherwise using the Service, you agree to these Terms.
1. The Service
ClearFeedback provides tools to collect feedback and surveys via an embeddable widget, triage submissions in a dashboard, and optionally publish roadmaps, ideas boards, and changelogs. Features and limits depend on your plan.
2. Eligibility and accounts
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You are responsible for your account credentials and all activity under your account. Provide accurate registration information and keep it updated.
3. Workspaces and team access
You may invite team members with roles such as admin, editor, or viewer. You are responsible for how your team uses the Service and for permissions you grant.
4. Your responsibilities
You agree to use the Service lawfully; configure widget origin allowlists and public boards appropriately; provide any notices and obtain any consents required for collecting personal data from your end users; and not misuse the widget, API, or integrations (including circumventing rate limits or security). You are solely responsible for content and data submitted through your widget and public boards.
5. Free trial, plans, and limits
New workspaces may receive a time-limited trial as described on our pricing page. After the trial, continued use of paid features requires a Starter or Professional subscription unless we agree otherwise. Plan limits (such as seats, widgets, and surveys) are described at purchase and in the dashboard. We may change plan features or limits with notice where required.
6. Fees, billing, and taxes
Paid subscriptions are billed through Polar.sh. By subscribing, you authorize recurring charges at the price and interval you select until you cancel. Taxes may apply. Refunds are handled as stated at checkout or as required by applicable law. Manage subscriptions via the Billing tab and the Polar customer portal.
7. Acceptable use
You may not reverse engineer the Service except where permitted by law; overload or disrupt our systems; resell the Service without permission; use the Service to build a competing product using our proprietary interfaces; or use the Service in violation of applicable export or sanctions laws.
8. Intellectual property
We own the Service, software, branding, and documentation. You retain ownership of your content and feedback data. You grant us a limited license to host, process, and display your content solely to provide and improve the Service.
9. Customer data and privacy
Our Privacy Policy at https://app.clearfeedback.io/privacy describes how we handle personal data. As between you and ClearFeedback, you are the controller of end-user feedback data you collect through the widget; we process it as processor according to your use of the Service. Business customers who need a data processing agreement may contact hello@clearfeedback.io.
10. Third-party services
Integrations and payment processing are provided by third parties under their own terms. We are not responsible for third-party services. Custom domains and DNS configuration are your responsibility.
11. Support and changes
We may modify, suspend, or discontinue features with reasonable notice where practicable. We strive for reliable uptime but do not guarantee uninterrupted or error-free operation.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARFEEDBACK AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS IF YOU HAVE NOT PAID FEES. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW (INCLUDING FRAUD OR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE WHERE APPLICABLE).
14. Indemnity
You will defend and indemnify clearfeedback.io against claims arising from your content, your use of the Service, your breach of these Terms, or your violation of others’ rights or applicable law.
15. Termination
You may stop using the Service and cancel subscriptions at any time. We may suspend or terminate access if you breach these Terms, fail to pay fees, or if required for security or legal reasons. Provisions that by nature should survive termination will survive.
16. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to resolve disputes arising from these Terms or the Service, except where mandatory consumer protection rules in your country give you the right to bring claims in your local courts.
17. General
These Terms are the entire agreement regarding the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale.
